President Donald Trump has called for an official investigation into former President Joe Biden’s use of autopen signatures, raising serious questions about who was truly exercising executive authority during Biden’s presidency.

In a memo released Wednesday, Trump directed White House Counsel and Attorney General Pam Bondi to launch a thorough review of whether Biden’s aides misused the autopen—a device that replicates signatures—to conceal what Trump described as signs of Biden’s “cognitive decline.” The concern, Trump says, is that staff may have unconstitutionally taken presidential actions under Biden’s name without his direct involvement.
“The American public was purposefully shielded from discovering who wielded the executive power,” Trump wrote. “This conspiracy marks one of the most dangerous and concerning scandals in American history.”
Autopen signatures have been used in the White House for decades, but mostly for ceremonial or routine documents. Trump himself admitted to using the autopen during his first term but emphasized it was reserved for “very unimportant papers.” In contrast, he claims Biden’s administration used it for key policies, including pardons, executive orders, and legislation.

“If aides secretly used the autopen while Biden was not mentally fit to govern, that would mean unconstitutional actions were taken under the guise of presidential authority,” Trump’s memo continued.
Biden pushed back forcefully in a statement, calling the investigation a political stunt.
“Let me be clear,” he said. “I made the decisions during my presidency. I made the decisions about the pardons, executive orders, legislation, and proclamations. Any suggestion that I didn’t is ridiculous and false.”
This isn’t the first time Trump has accused Biden of lacking the mental sharpness required to lead. But this latest move marks a more formal escalation of those claims. Trump and his allies argue that if staffers were effectively acting in Biden’s place—without transparency—then the legality of his executive actions could be called into question.
Though the use of autopen is legal under a 2005 memo from the Department of Justice’s Office of Legal Counsel—which states that a president doesn’t need to physically sign a bill for it to become law—Trump insists the issue is deeper than the signature itself. It’s about whether Biden was mentally present when those decisions were made.

House Oversight Committee Chairman James Comer, a Republican from Kentucky, has also taken interest. His committee is currently seeking testimony from several former Biden administration staffers as part of a parallel investigation.
The controversy has reignited debate around Biden’s mental fitness. Earlier this year, Special Counsel Robert Hur described Biden as a “well-meaning elderly man with a poor memory” in his classified documents report. Biden rejected that characterization, stating simply, “My memory’s fine.”
